فرایندهای قضایی در رسیدگی به سرقت علمی در ایران (با تأکید بر مرحله بدوی)

چکیده

مقدمه و اهدف: سرقت علمی به‌عنوان چالشی اصلی در پژوهش و علم، نه‌تنها از نظر اخلاقی بلکه به‌عنوان جرم قانونی شناخته می‌شود. این عمل، که به‌معنای استفاده غیرمجاز از آثار دیگران بدون ذکر منبع است، می‌تواند به خلاقیت آسیب بزند. در ایران، قوانین و مقرراتی برای پیشگیری و پیگیری سرقت علمی وجود دارد، اما روند قضایی آن کمتر مورد پژوهش قرار گرفته است. این پژوهش به بررسی فرایندهای قضایی در رسیدگی به سرقت علمی در ایران، با تأکید بر مرحله بدوی، می‌پردازد.
روش‌ها: این پژوهش با رویکرد توصیفی تحلیلی انجام شده است و از طریق بررسی قوانین و مقررات مرتبط با حقوق مالکیت فکری در ایران، فرایندهای قضایی را مورد تجزیه‌وتحلیل قرار می‌دهد. داده‌های این پژوهش از طریق تحلیل متون قانونی و مقررات قضایی مرتبط با سرقت علمی و مالکیت فکری گردآوری ‌شده و به‌صورت هدفمند انتخاب شده‌اند.
یافته‌ها: در ایران، سرقت علمی از طریق فرایندهای کیفری و حقوقی قابل پیگیری است. فرایندهای کیفری با طرح شکایت در دادگاه‌های عمومی کیفری و دادسرای فرهنگ و رسانه آغاز می‌شود، که هدف اصلی آن مجازات مرتکبان است. در فرایندهای حقوقی، تمرکز بر جبران خسارت‌های مادی به پدیدآورنده است. تشخیص سرقت علمی پیچیده است و نیازمند بررسی معیارهای مختلفی مانند استثناهای قانونی و استفاده منصفانه از آثار است.
بحث و نتیجه‌گیری: با توجه به پیچیدگی‌های موجود در قوانین مالکیت فکری و فرایندهای قضایی مربوط به سرقت علمی در ایران، این پژوهش به لزوم آگاهی بیشتر پژوهشگران از حقوق خود و راهکارهای قضایی موجود برای پیگیری این تخلفات تأکید دارد.
اصالت: رسیدگی به سرقت علمی در فرایندهای قضایی ایران موضوعی است که در پژوهش‌های دانشگاهی کم‌تر مورد توجه قرار گرفته است، شاید به این دلیل که شمار شکایت‌ها در این زمینه اندک هستند و آن هم به دلیل نبود آگاهی کافی در این زمینه است. این مقاله برای نخستین باید این فرایندها را پژوهیده است.
